GENERAL TERMS OF SALE

The present agreement regulates the general conditions of purchase for the various products and services offered on this website by IVAN JEWELRY S.L. with NIF number B65268153 and located at Calle de Trafalgar 13, bajos 1 bis, (8010) Barcelona (SPAIN).

The CLIENT at the moment they complete the registration process and purchase any of our products, expressly accepts and submits to the clauses specified below, as well as to the terms of access and use of our portal and its privacy policy, accessible through the link "Privacy Policy".

This contract is permanently accessible in the legal notices on our website.

1. PRICES AND TAXES

 

In consideration for the purchased product, the CLIENT expressly agrees to pay IVAN JEWELRY S.L. the amounts specified at the time of purchase in the price list established on the website www.ivanjewelry.com for the selected products.

The products offered on this website are subject to Value Added Tax (VAT). The prices listed for each product do NOT include VAT.

The prices of the products are subject to change without prior notice. We reserve the right to adjust prices at any time based on fluctuations in the silver market and other precious metals.

The delivery of the items will be considered to be located in the territory where VAT applies if the delivery address is situated in Spanish territory, except for the Canary Islands, Ceuta, and Melilla. The applicable VAT rate will be the one legally in force at any given time, depending on the specific article in question. For orders destined for the Canary Islands, Ceuta, and Melilla, deliveries will be exempt from VAT, without prejudice to the application of the corresponding taxes and duties in accordance with the regulations in force in each of these territories.

In the case of shipments to countries in the European Union, depending on the annual billing in that country, Spanish VAT will be deducted and the applicable VAT rate corresponding to the destination country will be applied. However, these orders may be subject to import and/or customs duties, depending on the regulations of each country.

In the case of the application of import and/or customs duties, these will be the responsibility of the recipient. Such costs may vary depending on the destination country, so in most cases, the expenses cannot be estimated prior to delivery.

Shipping costs are NOT included in the price of the products. In any case, the CUSTOMER will enjoy free standard shipping to the following destinations if the order exceeds the amounts detailed below:

  • Spain Peninsula and Portugal: 250 euros (€).
  • Balearic Islands, Canary Islands, Ceuta and Melilla, France and Andorra: 500 euros (€).
  • Germany, Austria, Belgium, Denmark, Italy, Luxembourg, the Netherlands, and the United Kingdom: 1000 euros (€).

Before proceeding to payment for the product, the final purchase price will appear on the screen, which will include VAT (Value Added Tax), management fees, packaging, and shipping costs, if applicable, which will be reflected in the order confirmation at the time of purchase and on the invoice.

Everything that is not specified in the description as included is not included.

2. PURCHASE PROCEDURE

 

Through this website, orders can only be placed by self-employed professionals and companies; this website is not intended for sales to individuals (consumers) or for retail.

On the website, all our products are detailed individually. The procedure for making and managing the purchase is indicated on the website, and you only need to follow these steps:

  1. Select the product you wish to purchase.
  2. By selecting a product, it can be added to the Shopping Cart, and you can choose to continue shopping or proceed with the order.
  3. To process the order, if this is your first time accessing our portal, you must complete a registration form with your personal information and create a personal account as a user. Once this step is completed, you will receive a confirmation at the email address you provided, indicating that the registration has been successfully completed. If you are already a registered user, to continue with the purchasing process, you only need to enter the username and password you created during your first purchase. The username and password are personal and belong to the person who completed the registration process, who is solely responsible for their custody. Through your account, you can manage the information we have and modify or update your data.
  4. Next, the order will be verified where the selected items are listed one by one and the total price is calculated.
  5. Additionally, it will be necessary to provide an address for billing purposes for the purchase made and specify whether the order will be picked up in-store or delivered to the home. It will be possible to provide a single address for both billing and delivery.
  6. Once the process has been completed, it will be necessary to check a box indicating that you have read and accepted the terms and conditions of sale.
  7. On the website, you will be provided with the mechanisms to make the payment based on the system chosen in each case.
  8. Once you have entered the payment information, you must confirm the order by clicking the "Buy" button.
  9. Once the "Buy" button is pressed, the order processing will begin.

The CLIENT is informed that the photographs of the products published as samples on the website may differ, not substantially, from the delivered product, as colors or shapes may be perceived differently by each consumer due to multiple variables, such as the devices used to view the products or environmental conditions like lighting. Furthermore, it is also noted that, being handmade jewelry, the characteristics of the product described on the website (weight, size, length, diameter, thickness, height, width...) are approximate and may have slight variations from those specified with a tolerance of 10%, without this altering the main characteristics of the product. However, these or other variables will never alter the characteristics of the products that will be described on the website, and in any case, the CLIENT may choose to withdraw from the purchase as indicated in these terms.

3. AVAILABILITY AND DELIVERY

 

The products offered by IVAN JEWELRY S.L. are available for distribution only in Germany, Andorra, Argentina, Australia, Austria, Belgium, Brazil, Bulgaria, Canada, Chile, China, Cyprus, Colombia, Costa Rica, Croatia, Denmark, Slovakia, Slovenia, Estonia, Spain (including Balearic Islands, Canary Islands, Ceuta, and Melilla), Finland, France, Greece, Hungary, Ireland, Iceland, Italy, Latvia, Liechtenstein, Lithuania, Luxembourg, Malta, Mexico, Monaco, Norway, Netherlands, Peru, Poland, Portugal, Puerto Rico, United Kingdom; Czech Republic, Romania, Sweden, Switzerland, Uruguay, USA.

Orders will be processed once payment has been received successfully.

The products offered by IVAN JEWELRY S.L. will always be subject to availability, which will be specifically indicated on our website for each product. Therefore, in the event that any offered item is not available, the customer will be duly informed of the lack of availability for the purchase. Under normal conditions, all products listed on our website are available for delivery within the indicated timeframes.

In cases where, once the order has been placed, the product contracted by the CUSTOMER is out of stock, they will be duly informed and offered an alternative product with similar characteristics at the same price and quality as the one purchased. If the CUSTOMER is still not interested in accepting the proposed alternative, IVAN JEWELRY S.L. will proceed with the refund of the amount already paid and will inform them of the procedures and timelines for the reimbursement.

As a general rule, the maximum time for product pickup in-store or home delivery will be 48 to 96 hours (2 to 4 days) from the moment of purchase and from the moment we have confirmed your payment. These delivery times are approximate and may vary depending on the destination (outside the mainland) or specific dates (for example, Christmas or sale periods). In any case, we provide a guideline table with the delivery times,

  • Standard shipping:
    • Spain (including the Balearic Islands, Canary Islands, Ceuta, and Melilla), Portugal, and Andorra: 1-2 business days.
    • France: 2-4 working days.
    • Germany, Austria, Belgium, Denmark, Italy, Luxembourg, Netherlands, United Kingdom: 3-5 business days.
  • Express shipping:
    • Germany, Andorra, Argentina, Australia, Austria, Belgium, Brazil, Bulgaria, Canada, Chile, China, Cyprus, Colombia, Costa Rica, Croatia, Denmark, Slovakia, Slovenia, Estonia, Finland, France, Greece, Hungary, Ireland, Iceland, Italy, Latvia, Liechtenstein, Lithuania, Luxembourg, Malta, Mexico, Monaco, Norway, Netherlands, Peru, Poland, Puerto Rico, United Kingdom; Czech Republic, Romania, Sweden, Switzerland, Uruguay, USA: 1-3 business days.

Deliveries will be made on business days (Monday to Friday). It is recommended that the CUSTOMER communicate their preferred delivery times when filling out the order details in the section designated for Comments.

If the CUSTOMER has chosen in-store pickup for the product, they will be notified at the provided email address when the order is ready and they can come to pick it up at the store.

If you have chosen home delivery for the purchased product, it will be carried out by the carrier along with a delivery note at the address indicated in the order that the customer must sign as a receipt document. Additionally, the CUSTOMER will be duly informed in case of any incident or if the delivery is delayed for any reason.

If delivery to the specified address is not possible due to the recipient's absence, you will be informed of how to proceed with the delivery and the new conditions for it. The carrier will leave a notice to arrange a new delivery or will contact the CUSTOMER directly to agree on either a delivery time or the pickup of the package at the corresponding office, or will inform you, in any case, of the steps to follow. Once the deadline has passed, if the CUSTOMER has not picked up their order, it will be returned to our warehouse and an email will be sent indicating how the delivery will be carried out finally. In this last case, the shipping costs will be borne by the CUSTOMER.

If the inability to deliver is caused by providing an incorrect address, the cost of reshipping the order will be borne by the CUSTOMER.

In order to keep you informed about the status of your purchase at all times, you will receive an email notification confirming your order and payment.

Likewise, the CLIENT can check the status of their order by sending an email to the address ventas@ivanjewelry.com.

4. PAYMENT AND PAYMENT PERIODS


The following payment methods are accepted:

- Tarjeta de Crédito y Débito: La transacción se realiza conectando directamente con la entidad bancaria Banco de Sabadell, S.A. a través de su pasarela de pago.

- Transferencia bancaria: realizando un ingreso del importe total de la compra en la cuenta corriente que se le indica.

Once the payment is made, you will receive a confirmation email for it.

IVAN JEWELRY S.L. does not have knowledge of the data related to your credit card. All our payment systems are completely secure.

Payments are required prior to the delivery of the product or the provision of the service, which is why IVAN JEWELRY S.L. will not provide the requested product until it has received payment for it. IVAN JEWELRY S.L. reserves the right to temporarily or permanently cancel the services provided in the event of any issues related to their collection.

5. INVOICES


You will receive your invoice along with the product at the time of delivery.

The CLIENT is responsible for confirming the receipt of notifications and for informing us of any changes to their data, with IVAN JEWELRY S.L. being exempt from any liability arising from this circumstance.

6. WARRANTY


At IVAN JEWELRY S.L., we strive to provide products of the highest quality; however, due to the nature of these products and the fact that sales are only intended for businesses and professionals (B2B), we cannot offer a satisfaction guarantee. If, for any reason, you do not receive the product correctly, you must inform us as soon as possible, indicating the issue, and we will attempt to rectify it as quickly as possible if the error is confirmed.

7. RETURNS


Returns or exchanges of products will only be accepted in the case of factory defects, damage during transport, or delivery errors. In any case, no more than 14 days should have passed since the receipt of the product, and the packaging and accessories must be included. It will be verified prior to acceptance that it is a manufacturing or packaging defect or anomaly and not due to improper or negligent use, handling, or storage. They must always be accompanied by the corresponding delivery note or invoice.

If it is not possible to include all accessories or original packaging, the CUSTOMER will be responsible for the decrease in value of the goods resulting from handling that is different from what is necessary to establish the nature, characteristics, and functioning of the goods.

It will be verified prior to acceptance that it is a manufacturing or packaging defect or anomaly and not due to improper or negligent use, handling, or storage. It will always be accompanied by the corresponding delivery note or invoice.

In the case of a return due to manufacturing or packaging defects, as well as in the case of an order error, CLIENT will be offered, if possible, the repair of the item or its replacement with another alternative at no additional cost and without the CLIENT having any right to any type of compensation. The costs incurred for the shipping of the repaired or correct order will be borne by IVAN JEWELRY S.L.

In any case, the return will always be subject to prior examination by IVAN JEWELRY S.L. of the condition of the product being returned and to the verification that the requirements set forth in these sales conditions have been met. Once the return is received and if applicable, we will refund the amount charged within a maximum period of 30 days and in the same terms that were used to make the payment.

IVAN JEWELRY S.L. reserves the right to refuse returns communicated or sent outside the established period or for products that are not in the same condition as when they were received.

Returns will be processed by sending an email to ventas@ivanjewelry.com providing a description of the reasons and causes stated for the return. Additionally, it will be necessary to indicate the name and surname and the order reference number. Once the request is received, we will process it promptly.

8. RIGHT OF WITHDRAWAL


Since this website is intended solely for wholesale (B2B) sales and purchases can only be made by professionals and companies in relation to their activities, it is not possible to withdraw from this contract.

9. PERFECTION OF THE CONTRACT AND MODIFICATIONS OF THE SERVICES


This contract will be perfected with the payment of the product.

IVAN JEWELRY S.L. reserves the right to modify in any way the characteristics and conditions of its services, always with the aim of improving them and providing a benefit to the CLIENT.

10. OBLIGATIONS OF THE PARTIES


IVAN JEWELRY S.L. is committed to providing the CLIENT with the products and services that have been contracted, applying the utmost diligence in the provision of the service, as well as taking care of the maintenance of the facilities necessary for the operation of the network, having an adequate technical and IT team for this purpose, and managing the logistics, shipping, and delivery operations of the purchase made through the carrier.

The CLIENT agrees to use the services made available to them in good faith, without violating current laws in any matter or infringing on the rights of third parties, as well as to pay for the selected product in the time and manner specified in these sales conditions and to receive it at the designated delivery location.

IVAN JEWELRY S.L. does not guarantee that the availability of the service subject to this contract will be continuous and uninterrupted, due to circumstances arising from problems in the Internet network, failures in computer devices, and other unforeseen circumstances. Therefore, the CLIENT agrees to bear these circumstances within reasonable limits, and expressly waives any claim against IVAN JEWELRY S.L. for any contractual or non-contractual liability for possible failures, errors, and use of the contracted service.

11. COMMUNICATIONS


All notifications between the parties will preferably be made via email. The CLIENT is responsible for confirming the receipt of notifications and for informing IVAN JEWELRY S.L. of any changes to their information, and IVAN JEWELRY S.L. is exempt from any liability arising from this circumstance. In the event of a change, the CLIENT must inform IVAN JEWELRY S.L. using the email or phone numbers provided on our website.

In compliance with Article 21 of Law 34/2002 on Information Society Services and Electronic Commerce, we inform you that our commercial communications and information related to our website and the products offered on it will be sent via email to the email address you provide, always with the option to revoke. In any case, you have the option to reject our commercial communications by sending an email to the address online@ivanjewelry.com indicating the word CANCELLATION in the subject.

12. COMMITMENT, ACCEPTANCE, AND VALIDITY OF THE CONTRACT


The CLIENT acknowledges having read and accepted the legal terms of use and the privacy policy of the website.

The CLIENT acknowledges that it has understood all the information regarding the products and services, including, where applicable, delivery, offered on our website, as well as all the conditions and stipulations set forth in this electronic contract, and therefore affirms that they are sufficient to exclude any error in the consent of this contract, and consequently, accepts them in full and expressly.

The CLIENT is fully aware that the acceptance and execution of this contract will take place through the provision of their data and by clicking the “Buy” button indicated on our website, and that it will be finalized with the payment for the service.

13. APPLICABLE REGULATIONS


This contract is of a commercial nature and will be governed and interpreted in accordance with Spanish laws.

In the event that any type of discrepancy or difference arises between the parties regarding the interpretation, content, or execution of the Contract that is not resolved by mutual agreement, the Parties shall submit to the courts or tribunals of Barcelona.
